3. Letter Before Action (LBA)

A Letter Before Action is a legal requirement before court proceedings can begin.

This letter:

  • States the debt amount owed
  • Gives a deadline for payment (14 days for limited companies, 30 days for individuals/sole traders)
  • For business debts, we add a late payment fee (£40, £70, or £100 depending on the debt size) in line with the Late Payment of Commercial Debts (Interest) Act 1998.
  • You may also add 8% interest above the Bank of England base rate

 

4. Contacting the Debtor

Between the deadline dates, we:

  • Call and email the debtor to request payment
  • Negotiate payment terms if necessary
  • Keep you updated via our 24/7 online portal, email, or phone

 

If You Still Haven’t Been Paid – Next Steps

5. Legal Claim

If the debtor still hasn’t paid:

  • We help you submit a claim to the Small Claims Court (upon payment of the court fee)
  • The debtor receives a court from requiring payment within 14 days
  • Alternatively, we can take insolvency action, including wind-up proceedings for companies or bankruptcy proceedings for individuals

 

6. Judgment

If the debtor ignores the court claim:

  • The court may issue a County Court Judgment (CCJ)
  • This stays on their credit file for 6 years unless paid in full within 1 month
  • A CCJ allows you to take further enforcement action to recover the debt

 

7. Enforcement

With a CCJ in place, you can:

  • Instruct High Court Enforcement Officers
  • The bailiff with request payment within 7 days
  • If payment is not made, they can seize goods or assets to cover the debt
